1. What the Service is
Get Chow provides a WhatsApp-based ordering and payment service for independent restaurants. We facilitate orders and collect payment from Customers on behalf of Partners, and we settle amounts due to Partners on a weekly cycle, less our agreed service fees. We are a technology and payment-facilitation service. The food is prepared, sold and supplied by the Partner.
2. Permitted use
The Service may only be used to:
- Order, sell and pay for food, beverages and directly related items from verified restaurant Partners.
- Communicate about orders, including status, changes and collection.
3. Prohibited use
The Service may not be used to:
- Sell anything other than food, beverages and directly related restaurant items. This includes, but is not limited to, alcohol (unless the Partner holds a valid liquor licence and we have approved it in writing), tobacco, medicines, weapons, counterfeit goods, or any illegal goods or services.
- Process payments unrelated to a genuine food order, such as cash-out, money transfer, or paying for goods or services outside the Service.
- Split, disguise or misrepresent transactions.
- Harass, abuse or defraud any Customer, Partner, or member of our staff.
- Infringe any third party's intellectual property, such as menus, images or brand names.
- Send unsolicited marketing in breach of WhatsApp's Business terms or South African law, including POPIA and the Consumer Protection Act.
- Circumvent, probe or interfere with the security or operation of the Service.
4. Partner obligations
Partners must:
- Hold and maintain all licences required to operate a food business at their premises, including a valid Certificate of Acceptability.
- Keep menus, prices and availability accurate.
- Prepare food in accordance with applicable health and safety laws.
- Honour confirmed orders, or promptly cancel and refund them in line with our Refunds Policy.
- Provide accurate business, tax and banking information, and keep it up to date.
5. Customer obligations
Customers must provide accurate contact details, pay only for their own genuine orders, and not initiate fraudulent chargebacks.
6. Enforcement
We may, at our discretion, warn, suspend or remove any Partner or Customer; withhold settlement of funds connected to suspected fraud or breach while we investigate; cancel orders; and report unlawful activity to the authorities and our payment provider. Where funds are withheld, we will resolve the investigation within 30 days and either release or refund the funds as appropriate.
7. Changes
We may update this Policy from time to time. The current version is always available at getchow.co.za/legal. Continued use after an update constitutes acceptance.
